End-user licence.

Software covered

This agreement covers the Small Meridian browser runner and any Small Meridian game or demo supplied with this agreement, including its associated assets and updates (the "Software"). It does not give you access to an unannounced or unavailable game.

Small Meridian is the licensor. Installing or using Software supplied under this agreement means accepting the agreement in effect for that Software. If you do not agree, do not install or use it.

Your licence

We grant you a limited, non-exclusive licence to use the Software for your own personal, non-commercial use on devices you own or control, subject to this agreement and any applicable platform terms.

The Software is licensed for use. Its code, artwork and other protected materials remain the property of Small Meridian or their respective owners. Rights not granted by this agreement remain with those owners.

Restrictions

Do not sell, rent, sublicense or redistribute the Software without permission. Do not remove ownership notices, bypass licence protections, use the Software to infringe another person's rights, or deliberately interfere with another user's access.

Copying, modification and reverse engineering are permitted only where applicable law, a separate component licence or our written permission allows them. This agreement does not restrict rights that the law prevents us from restricting.

Platforms and third-party components

A platform used to obtain or run the Software may impose its own terms. Purchases, payments and refunds through that platform are governed by its rules and applicable law; this agreement does not change the platform's obligations.

Components supplied under a separate open-source or asset licence remain subject to that licence. Its permissions take precedence over conflicting restrictions in this agreement for the component concerned.

Updates and availability

We may provide updates, corrections or changes to the Software. No particular future feature or update is promised. A free browser demo may be changed or removed from the website.

Any requirement to update, changes to a purchased product and the continued use of an existing copy remain subject to the applicable platform agreement and consumer law.

Privacy

The website privacy policy describes the current browser demo and correspondence with Small Meridian. A separately distributed game with different data handling must provide privacy information appropriate to that game. This agreement does not authorize undisclosed tracking.

Ending the licence

You may end this licence by stopping use of the Software and deleting copies held under it. We may end the licence for a material breach where the law permits, with any notice and opportunity to remedy that the law requires.

After the licence ends, stop using the Software and remove copies except those you are entitled to retain under another licence or applicable law. Ending the licence does not remove a refund right or other remedy protected by law.

Warranties and liability

The Software may contain errors or interruptions. Except for warranties and obligations required by law, we do not promise that it will run without faults or work on every device.

To the extent permitted by law, Small Meridian is not responsible for indirect or consequential losses arising from use of the Software. This does not exclude liability for intentional or gross fault, or any liability, warranty or remedy that cannot legally be excluded.

Applicable law and agreement changes

The laws of Québec and the federal laws of Canada that apply there govern this agreement, subject to mandatory protections available where you live. Disputes may be brought before a court with jurisdiction. No mandatory arbitration or class-action waiver is imposed.

We will identify the effective date of any revised agreement and provide notice or obtain acceptance where required. A revision does not retroactively remove rights under an existing licence. If one provision cannot be enforced, the remaining provisions apply to the extent the law permits.
